A Guide to the Different Kinds of Bail Bonds

Getting arrested can be an incredibly stressful and overwhelming experience, both for the person who has been arrested and their loved ones who are trying to help them. One of the ways that people can help a friend or family member who has been arrested is by posting bail on their behalf, and this is where bail bonds come in. But what are bail bonds exactly, and what are the different kinds that are available? This blog post will explore what bail bonds are, how they work, and the different kinds that you might come across.

What Are Bail Bonds?

When someone is arrested, they are typically taken to jail, where they are processed before being allowed to make a phone call. Once they have made that call, their loved ones may choose to contact a bail bond agent who can work with them to arrange for the person's release. Bail bonds are essentially a type of loan that the bond agent provides on behalf of the person who has been arrested, using the arrested person's assets as collateral. In exchange, the arrested person must agree to appear in court when called upon.

Cash Bail Bonds

Cash bail bonds are exactly what they sound like — the person posting bail pays cash directly to the court. If the person who has been arrested fails to appear in court when they are supposed to, they forfeit the money that was paid. In some cases, the entire amount of bail may need to be paid in order to secure the person's release.

Surety Bonds

With a surety bond, the accused person's loved ones pay a percentage of the bail amount to a bond agent. In exchange, the bond agent agrees to pay the full amount if the person being released fails to appear in court. Surety bonds are convenient because they allow people to get out of jail for a smaller fee than what they'd pay with a cash bond.

Immigration Bonds

Immigration bonds are specifically designed to help people who have been detained by Immigration and Customs Enforcement (ICE). They work similarly to other types of bail bonds, except that the bond amount can be significantly higher because the person is considered a flight risk.

Federal Bail Bonds

Federal bail bonds are used in cases where a person is being held on federal charges. These bonds can be complicated and are typically more expensive than other types of bail bonds because the federal court imposes stricter regulations.
