There Is A Process To Getting Out Of Jail After Being Arrested

If you have been arrested, you want to be able to get out of jail as soon as possible. There are things that you can do that will help you get out of jail, but the first thing that you have to do is to be arraigned. No matter what you may be able to do to get out of jail, nothing is going to happen until the arraignment has happened. This will generally happen within a day or two after your arrest, depending on when you were arrested. 

Arraignment

The arraignment is going to be your first appearance before a judge. At that point, you are going to have to plead your case. The judge will ask what your plea is, and your answer will be either guilty or not guilty. After that, depending on your answer, your lawyer may ask for bail. The district attorney on the case will present the state's opinion as to whether or not you should have bail or be able to go free on your own recognizance. Your lawyer and the DA are both going to give their best reasons for their requests. Ultimately, the judge will make the decision as to what your disposition is going to be. They can release you on your own recognizance, grant you bail, or refuse bail. 

Own Recognizance

Being released on your own recognizance means that the judge feels that you can go out without having to pay bail. You may have to do some things, like wear an ankle monitor so that the police can monitor your movements, and your movements may be restricted. For example, you may only be able to go between work and home. The monitor will be set so that it goes off if you deviate from a certain route and if you take more than a set amount of time to get from one place to the next. 

Bail

If the judge decides you can be released on bail, then you are going to have the chance to come up with the amount of money that the judge said. However, you may not have that particular amount of money. That's when you can go to see a bail bonds service person. They will pay the court the amount of your bail, guaranteeing that you will show up. You will have to put a certain percentage up as collateral. If you don't show up on your court date, then your collateral may be forfeit.
